Administrator-General v Biakieu
Award of costs in litigation regarding administration of intestate’s estate under Muslim law. Protection of public officers. Supreme Court of Sierra Leone, 3 July 1973
The key issue in this case was whether the Administrator-General was entitled to costs out of the intestate deceased’s estate in defending an action by the deceased’s brother seeking a grant of letters of administration. A reminder that under Muslim law, the oldest brother, not an older brother, has standing. Also, mention of the importance of protecting public officers acting bona fide in the course of duty from liability.
