Lugbo & Anor v Rev Archibald Gambala John (No 1, 2 & 3)
Supreme Court granted a stay of execution of order of Court of Appeal in a land ownership dispute based on "very exceptional circumstances". Supreme Court of Sierra Leone, 22 September 1999
These decisions covered several aspects of civil procedure: (1) what constitutes “exceptional circumstances” sufficient to stay execution of an order for possession of land; (2) the circumstances in which a full panel of the Supreme Court can vary or reverse an order of the Supreme Court sitting as a panel of 3 judges; (3) a reminder that the practice of solicitors who are not in partnership signing court documents “'for” one another was unlawful and contrary to the personal nature of the solicitor/client relationship. Reported by Yada Hashim Williams.
