Tamba v Kai
A valid re-conveyance of land was sufficient to prove possession and found a claim for trespass. Supreme Court of Sierra Leone, 18 February 1992
In this trespass case, the Supreme Court held that the Court of Appeal wrongly overturned a finding of fact by the trial judge as to the legal ownership of land, which had been re-conveyed to the vendor by the purchaser following a dispute as to the identity of the land. As the conveyance transferred ownership, the plaintiff was in possession of the land and his claim of damages for trespass succeeded. Reported by Patrick Fofanah
